The change of focus of the work continues as Commercial Arbitration:Law and Practice moves from being directed substantially towards commercial arbitration to that of dispute resolution generally, including Expert Determination, Mediation, the Referee System (in New South Wales under Part 22 of the Uniform Supreme Court Rules), and more importantly the ever increasing relevance of the Security of Payments legislation in the Building and Construction Industry.
The objective of the Security of Payments legislation is to ensure that any party that contracts to carry out construction work, or supply related goods or services, on projects for the private and public sectors is entitled to promptly receive all progress payments that are due, including final payments and retention monies. Marcus Jacobs QC selects and comments upon recent important cases on this legislation, and in some cases, provides a critical analysis of the court decision.
Recent English decisions are continually being evaluated by the author as this is of considerable practical benefit to practitioners and the legal profession generally and contributes to the development of the commentary.
